1. Scope and Provider

These Terms of Service apply to all orders placed through the online shop arvaehome.com. The shop is operated by:

Orders are shipped from our European warehouse: Ritscherstrasse 11, 21244 Buchholz in der Nordheide, Germany. Our products and services are aimed at consumers in Europe. These Terms of Service apply to consumers unless mandatory statutory provisions prevail.

2. Contract Conclusion

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. When you submit an order, you make a binding offer to purchase the selected products. The purchase contract is concluded once we confirm your order by email (order confirmation) or ship the goods. The order confirmation may be sent automatically.

3. Prices and Payment Terms

All prices are stated in the currency shown in the shop and include the applicable statutory VAT where this applies. Additional costs (e.g., shipping costs) are shown transparently at checkout before you complete your order. Payment is made using the payment methods offered at checkout.

4. Delivery and Shipping

We deliver exclusively to delivery addresses within Europe. Processing time is generally 1–2 business days after order confirmation. Delivery time within Europe is generally 3–7 business days, depending on the destination. All information about shipping, delivery times and shipping costs can be found in our Shipping Policy.

5. Consumer Right of Withdrawal

Consumers have the right to withdraw from the contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the last goods. To exercise the right of withdrawal, it is sufficient to send an unequivocal statement (e.g., by email to Service@arvaehome.com) before the period expires. The full withdrawal notice and the model withdrawal form are available on request or via the EU Commission platform at https://ec.europa.eu/consumers/odr.

6. Returns, Warranty and Guarantee

In addition to the statutory right of withdrawal, we offer the conditions described in our Refund Policy (including the 15-day return and exchange right and a manufacturer's warranty of at least 1 year). Statutory warranty rights (liability for defects) under the applicable provisions remain unaffected.

7. Liability

We are liable without limitation for intent and gross negligence as well as for damage arising from injury to life, body and health. In the case of simple negligence, we are only liable for breach of material contractual obligations (cardinal obligations), limited to the contract-typical, foreseeable damage. Liability for slight negligence is otherwise excluded to the extent permitted by law. Statutory product liability provisions apply.

8. Retention of Title

Until payment is made in full, the delivered goods remain our property.

9. Applicable Law and Dispute Resolution

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless this places consumers at a disadvantage; mandatory protective provisions of the law of the country in which you have your habitual residence remain unaffected. The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

10. Final Provisions

If individual provisions of these Terms of Service are invalid, the validity of the remaining provisions remains unaffected. The statutory provision takes the place of the invalid provision. The place of jurisdiction for merchants, legal entities under public law and special funds under public law is the registered office of the operator, to the extent permitted by law.
